China now has its legal system in place, and in recent years it has assembled substantive laws and regulations that govern the workplace, the employment relationship, and the contractual and statutory rights and benefits of its workers. As China moves ahead to raise the legal standards and levels of coverage and enforcement in these areas and its social security safety net, it also seeks to balance its very successful economic growth and competitive advantages especially as these relate to labor. Employers face increasing obligations and technical legal requirements, which in earlier years did not exist or at least were not consistently enforced. The current global economic downturn now puts added pressures on China to maintain advancement in labor and employment laws.

This book grew out of discussions with Dr. Rainer Moufang, my long-time friend from the Max Planck Institute for German and International Intellectual Property (The institute has been renamed as the Max Planck Institute for Intellectual Property, Competition and Tax Law). On a cold, quiet afternoon in Munich in 2006, we sat in his office discussing the need for a comprehensive review of fundamental and contemporary patent issues as they relate to the protection of both traditional and new technologies. We envisioned a book that would appeal to both academics and practitioners, and we selected experts from three major patent jurisdictions – the United States, Europe and Japan – who could write on each topic. Although we granted these authors complete freedom with regard to writing style, we strongly encouraged them to analyze their topics from the comparative law perspective.

Three months after I became Police Commissioner of the City of Philadelphia in March 1998, a young female graduate student was sexually assaulted and murdered by an unknown intruder. I suspected that this was not the first time that this perpetrator had struck and so I directed our detectives to go back over old cases to see whether they could find any evidence of previous attacks by the same person. After spending months searching through old files and sending large numbers of DNA samples to the laboratory for analysis, our investigators reported to me that they believed that he had struck almost exactly one year earlier. In fact, they were now pretty sure that during the summer of 1997 he had sexually assaulted four women under similar circumstances: undetected intrusion into the victims’ apartments during the early morning hours while the victims were asleep in their beds.

In the quarter-century since this book first appeared, there have been few moments of uncertainty as to the direction of international relations and international law to compare with the early years of the twenty-first century. Globalisation has brought undoubted benefits in the fields of commerce, technology and communications, but also increased dangers concerning the rapid spread of disease and the growth of international terrorism. The clearly understood rules and limitations as to state conduct apparent during the ColdWar period have disappeared and (for the moment at least) the optimism engendered by a renewed United Nations in the early 1990s has dissipated. Increasing resort to force by states, entities and individuals coupled with the apparently easy access to weapons of high destructive capacity pose a significant challenge to those wishing to establish a world order based on justice,mutual respect, toleration and forbearance.

Economic, social and cultural rights (ESC rights) are protected in several international human rights instruments, the most comprehensive being the International Covenant on Economic, Social and Cultural Rights (ICESCR or ‘the Covenant’), which has been ratified by a vast majority of states. In January 2002 Fiji presented its first ever country report to the United Nations committee charged with monitoring compliance with the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW). One of the most controversial sections of the report addressed the use of the practice of bulubulu, or village reconciliation, in cases of rape. During the public presentation of the report in New York City by Fiji’s Assistant Minister for Women, the nuances of bulubulu as a sociolegal practice in postcolonial Fiji were obscured within what quickly became complicated layers of political miscommunication, the imperatives of a surging Fijian nationalism, and, as always, the politicization of culture.
